From the supplier: The rise in state lawsuits based on health care costs incurred because of tobacco is accompanied by increased efforts by workers to receive compensation for the harm done by secondhand smoke. Environmental tobacco smoke has been proven harmful to nonsmokers that are regularly exposed to smoke in the workplace. In some states, most workplaces no longer allow workers to smoke cigarettes on the job. Class actions and individual suits have been filed under products liability laws, the Americans with Disabilities Act and the Federal Employers' Liability Act.
